A man got a 17 year prison sentence for beating and raping an elderly woman at the Palo Alto Commons nursing home is Califorina. The nursing home abuse and rape occurred in 2002.
Roberto Recendes, 43, who was tied to the crime via DNA evidence in 2008, pleaded guilty last October to one count of sexual penetration by force, one count of elder abuse, and to a penalty enhancement for inflicting great bodily injury. Recendes made a plea deal which kept him from a 25 years to life sentence.
The nursing home beating and rape victim died in 2006.
Recendes was deported to Mexico in 2004 after being convicted of domestic violence. A DNA sample taken at that time was used to link Recendes to the rape and beating of the 94-year-old woman at the Palo Alto Commons nursing home. Recendes was then brought back to the USA.
Nursing home abuse can take many forms with varying degrees of severity; however, all nursing home abuse and neglect is illegal and should be taken seriously. If you or a loved one has been a victim of nursing home abuse, or if you suspect abuse, you are advised to contact a nursing home abuse lawyer to discuss your legal options.
